SIGNIFICANT CASES AND PUBLISHED DECISIONS

 

Presley v. Carter Hawley Hale Profit Sharing Plan, Case No. C-97-04316 SC, Federal Court for the Northern District of California--Counsel to class in ERISA class action to recover losses from employee stock-option plan for 20,000 former employees of Carter Hawley Hale Corporation. Litigation resulted in $36 million settlement for class. Judgment entered on January 7, 2000.

Voters For Responsible Retirement v. Board of Supervisors (1994) 8 Cal.4th 765 (Amicus Curiae)-Court adopted argument advocated in Amicus brief as majority opinion in case involving public employee retirement rights.

Claypool v. Wilson (1992) 4 Cal.App.4th 646--Represented plaintiffs in litigation concerning pension rights of California public employees.

PUBLICATIONS AND PRESENTATIONS

Over the years, I have given many presentations and talks to different groups on a variety of issues related to arts and entertainment and intellectual property law. In particular, I have given presentations on licensing art and design, artist gallery contracts and literary agent and publishing contracts. Many of these talks have been presented under the auspices of the California Lawyers for the Arts. I have also given presentations on general issues in copyright and trademark law to community groups and professional associations.

Several of my cases have received press attention, most notably the case of Starbucks v. Dwyer, in which Starbucks Corporation sued the cartoonist Kieron Dwyer for copyright and trademark infringement and trademark dilution arising out of a parody of the Starbucks mermaid logo created by Dwyer.
